Please read these terms and conditions carefully before using the AVG Bags website (hereinafter referred to as the "Site"). By using and purchasing from the Site, you agree to the following Terms and Conditions. As the Terms and Conditions may occasionally be updated, we recommend that you visit this page regularly to note any such changes.

These Terms and Conditions are intended to regulate the commercial relationship between PILAR ANTÓN, S.L., a Spanish business organisation, whose corporate office is at German Bernacer, 11 – Parque Empresarial de Elche, 03203 Elche (Alicante), SPAIN,  and whose tax identification number (C.I.F.) is B-53476255, entered in the Commercial Register of Alicante, Volume 2338, Book 126, Section 8, Page A-59216, entry 1, and You, relating to all transactions made on the online store.

AVG Bags is a brand manufactured solely and exclusively by the PILAR ANTÓN, S.L. company in Spain.

WEBSITE USE AND USER DATA
To ensure legal use of the Site, users agree not to use the Site for purposes that are fraudulent, that are related to criminal offences or illegal activities of any kind, that are incompatible and/or harmful to rights and interests of any kind, that breach any other provision of use agreed on in these Terms and Conditions and that are against the law. Similarly, users of the website agree to use the website in accordance with the law and generally accepted habits and practices. Likewise, users undertake not to impede the normal development and use of the products and services offered on the Site owned by AVG BAGS.

AVG BAGS expressly prohibits the use, sending or reuse of material that is illegal, indecent, abusive, defamatory, obscene or threatening in any way, or that constitutes a violation of copyright, trademarks or confidentiality, privacy or any other rights, or is otherwise injurious or objectionable to third parties, or whose content contains political or other forms of advertising, computer viruses, chain letters, mass mailings or any other type of "spam" and, in general, anything that causes any kind of unnecessary inconvenience or trouble.

In order to purchase the products offered on the Site, the User must register via the registration form provided on the Site. Users are responsible for maintaining the confidentiality of the data and information provided, restricting access to their computer and passwords in order to prevent possible unauthorised use, checking that their data are correct and complete and informing AVG BAGS of any variations and/or changes to the information provided in the purchase process.

Should the user have reason to believe that their data have been revealed to a third party, or have been or are likely to be used in an unauthorised manner, this situation must be reported to AVG BAGS as soon as it becomes known.

AVG BAGS reserves the right to modify, update and delete the information contained on the Site or cancel orders at its discretion, and may even limit or deny access to such information to certain users.

Despite doing everything in its power, AVG BAGS cannot guarantee access for all users and continuous and uninterrupted use of the Site, and is therefore accepts no responsibility should such a situation arise.

Users accept that all their personal data will be fully transferred to the company Aplazame from the moment the users contract the deferred payment service offered by the latter on having chosen the payment method. This acceptance is extended to third parties with access to the files for the purpose of successfully fulfilling the contract.

INTELLECTUAL AND INDUSTRIAL PROPERTY

Any type of information contained on the www.avgbags.com website, property of AVG BAGS, is protected by copyright and other rights contained in Royal Legislative Decree 1/1996, of April 12, approving the consolidated text of the Law of Intellectual Property, regularising, clarifying and harmonising current legal provisions on the matter.

The intellectual property rights to the content of the web pages, their graphic design, source code, navigation structures and elements contained therein are the property of AVG BAGS, who are the sole holders of the rights to their exploitation in any form, in particular, the rights of reproduction, distribution, public communication and transformation, in accordance with the applicable Spanish and European law. Therefore, total or partial reproduction, distribution, public communication, transformation or any other activity that may be carried out on the content of the Site is prohibited, even when quoting the sources or providing a hyperlink.

AVG BAGS states that the data included in the Site in each description of the products and services, their photographs, graphic or iconographic representations or videos as well as commercial names, brands or identifying marks of any kind are for information purposes only. Therefore, it accepts no responsibility for the appearance of errors in the information, although once such errors or omissions are detected or reported, it agrees to take all measures within its power to correct them as soon as possible.

AVG BAGS states that it does not grant licenses or express or implicit authorisation to the rights of intellectual and/or industrial property or any other right or property directly or indirectly related to the content of the Site.

Furthermore, trade names or trademarks, titles, labels, names, logos, slogans or any other distinctive mark that appear on the Site cannot be used without prior express written consent from AVG BAGS.

SHIPPING & RETURNS

SHIPPING

Given the current pandemic situation, there may be delays to shipments or, in some areas, delivery may not be possible after shipment.

SHIPPING INFORMATION

* Only countries enabled in the shipping information table are available. For other countries, please consult pilaranton@bolsosavg.com.

Conditions:

- Shipments are made from Monday to Friday during working hours.

From Monday to Thursday, orders placed after 3 pm (Spanish time) will be calculated from 8 am the following day.

Orders placed at the weekend (from Friday at 3 pm) will be calculated from Monday at 8 am.

- One delivery attempt will be made by the carrier. If unsuccessful, your order will be deposited at the collection point nearest you for collection on the following days. After a few days, the order will be returned to our warehouse, generating shipping costs for the repeat processing, even if the initial order was free of charge.

- Your telephone number is required for the carrier to contact you if necessary.

- The delivery address may not be changed once the order has been confirmed.

- If you need to change any of the details, please contact pilaranton@bolsosavg.com as soon as possible to report the incident.

- Orders are processed automatically and we cannot advance or delay delivery times.

- Any customs charges that are incurred will be payable by the customer in all cases.

EXCHANGES AND RETURNS

GENERAL TERMS AND CONDITIONS

- You may exchange or return any model purchased from our online shop within 14 days of the delivery date.

- The product to be exchanged or returned must arrive at our facilities in the same condition in which it was sent, with no signs of having been used and in its full original packaging (box, protectors and labels).

EXCHANGES

Conditions

- Exchanges require a new purchase operation.

2) We will let you know the steps to take to ensure we receive the product.

3) Once the goods have been received, we will check whether they comply with the conditions for their exchange and return, as stated in the previous section: "General Conditions".

4) If the exchange is accepted we will inform you by email and send the requested product.

5) If the exchange is refused we will inform you of the reasons, also by email, and make the product available to you in the same condition and packaging as we receive it so that you can order its collection.

RETURNS (TOTAL OR PARTIAL)

Conditions

- Refunds are operations that require total or partial reimbursement of the payment made.

- In the case of returns, the customer will be responsible for shipping and collection costs in all cases.

Procedure for returns (total or partial)

2) We will let you know the steps to take to ensure we receive the product.

3) Once the goods have been received, we will check whether they comply with the conditions for their exchange and return, as stated in the section of this document titled: "General Conditions".

4) If the return is accepted we will inform you by email and issue the corresponding refund by the payment method you first used. The deposit cannot be made by any other method.

The refund will cover the cost of the returned products, excluding any shipping costs included in the initial order.

5) The time required to process the refund may vary depending on the payment method used:

Credit card: Our bank will refund the amount of the return seven days after the return confirmation email is accepted. The time it takes for the amount to appear in your account depends on your credit card provider.

PayPal: You will receive the refund in your PayPal account within 24 hours of receiving the accepted return confirmation email.

6) If the return is rejected, we will inform you of the reasons, also be email, and make the product available to you in the same condition and packaging as we receive it, for you to order its collection.

Links on the Site do not imply any kind of relationship, acceptance or endorsement between AVG BAGS and the owner of the website to which the link is directed. Links contained on the Site may lead to third party pages. AVG BAGS accepts no responsibility for the content, information or services appearing on these sites, which will be understood to be offered exclusively for information purposes by AVG BAGS.

LEGAL AMENDMENTS AND NOTIFICATIONS

The information on this website is valid as of the date of its last update. AVG BAGS reserves the right to review and modify these Terms and Conditions of Use, as well as its privacy policy and any other information at any time. Changes to the Terms and Conditions shall be effective from the time of their publication on this website. Users are subject to these Terms and Conditions of Use from the moment of their acceptance, unless a modification with retroactive effect is required by law, in which case such modifications will apply to previously confirmed orders.

Should a clause of these Terms and Conditions be declared invalid, the remaining clauses shall remain valid and be interpreted in the spirit of these Terms and Conditions.

AVG BAGS may translate these Terms and Conditions, its Privacy Policy, or any other operational rules, policies or procedures that may be posted on the Site. However, in case of conflict, the Spanish version will prevail.

By accepting these Terms and Conditions of Use, you agree and undertake to conduct most of your communication with AVG BAGS electronically to the following address: pilaranton@bolsosavg.com. Therefore, communication between AVG BAGS and users regarding contracting orders through the Site shall be made in writing and in accordance with the communication procedures established in these Terms and Conditions for each particular case.

APPLICABLE LAW AND JURISDICTION

The operation and use of the www.avgbags.com website, as well as these Terms and Conditions of Use, are subject to applicable Spanish law. AVG BAGS further states that for any issues or disagreements arising in relation to the Site or to these Terms and Conditions of Use, users and avgbags.com accept the jurisdiction of the courts and tribunals of the city of Elche, expressly waiving any other applicable jurisdiction.
